Makerspace User Agreement and Release of Liability
Warning of Risk
Use of tools, equipment, and machinery in the Makerspace involves inherent risks, including, but not limited to: slips, cuts, burns, eye injury, hearing damage, chemical exposure, fire, electrical hazards, and equipment malfunction or misuse. By signing this Agreement, the User acknowledges and accepts all risks associated with Makerspace use.
Conditions of Use
User agrees to follow all Library rules, instructions, required training, and safety procedures. User is responsible for damage caused by negligence. Personal insurance shall be primary. Library staff may terminate use for safety reasons.
Personal Property Disclaimer
The Library is not responsible for loss, theft, or damage to personal property or project materials.
Permission for Use of Likeness
User grants the Library permission to photograph, record, and use their image, likeness, and voice for promotional, marketing, and educational purposes in any media without compensation. User must notify the Library in writing to opt out, which does not apply retroactively.
Intellectual Property Disclaimer
User understands the Library does not protect, monitor, store, or enforce intellectual property rights related to designs, files, prototypes, trademarks, copyrights, patents, or creations. The Library is not liable for theft, copying, or infringement claims. Users are solely responsible for securing and defending their intellectual property.
Assumption of Risk, Waiver, and Release
User assumes all risks and releases Smyth County Public Library, Smyth County, the Library Board, staff, volunteers, and agents from any liability. User agrees to indemnify and hold harmless the Library from claims arising from Makerspace use.
Medical Authorization
If injured, User authorizes emergency treatment at their expense.
Governing Law
This Agreement is governed by Virginia law. If any section is invalid, the remainder remains enforceable.
User Acknowledgment
User acknowledges they have read and initialed each page and voluntarily accept all terms. Unauthorized equipment use may result in revoked privileges.
